These Terms & Conditions specify the terms of use of the website (www.greenline.in) as well as other applications, if any (collectively "Greenline Platforms") which are to be complied with, in letter and spirit, by any and every visitor of the Greenline Platform.

 

All Greenline Platforms are owned by Greenline Mobility Solutions Limited and are designed, updated and maintained independently by it. In these terms and conditions “We”, “us”, “our”, “Greenline” are used for Greenline; and "You", "your", "yours" is used for the visitor of a given Greenline Platform.

 

From Your visit (i.e. access and use) to a given Greenline Platform and the continued use of the same, following shall be presumed:

 

1.       You have read these terms and conditions carefully, before proceeding any further;

2.      You are 18 years or above; and are aware of the risks  inherent, in the continued use of a given  Greenline Platform, and arising from the obligations, representations and warranties set forth in these terms and conditions;

3.      You are aware that the terms and conditions, as set forth here, are subject to change without any notice, in the sole and absolute discretion of Greenline and therefore you will continue to use the Greenline Platform only upon reading these terms and conditions.

 

Licence to Access And Use

Greenline hereby grants You a licence to access and use a given Greenline Platform, on a limited, revocable, non-exclusive, non-transferable, non-sublicensable basis, provided you continue to abide by these terms and conditions in letter and spirit.

 

Acknowledgement

You acknowledge that any and every information displayed, transmitted or carried on a given Greenline Platform (“Content”) is protected under applicable intellectual property law and is either owned or licenced by Greenline.

Hence, copying, storing, using etc., whether in whole or part, other than for your personal, non-commercial use is not permitted without the express permission of Greenline.

 

Likewise, any commercial exploitation of the Content is also not permitted including any modification, publishing, transmission, transfer, sale, reproduction, creating derivative work from, distribution, reposting, performing, displaying etc. of the same. 

 

You further acknowledge that accessing data not intended for you or logging onto a processor, or access device or account which you are not authorized to access is strictly prohibited.

 

Additionally, You shall also not interfere with or disrupt the services for any other user, including, without limitation, by way of submitting a virus, or worm in the network or otherwise. You shall not use the Greenline Platforms to send any unsolicited e-mail or other information, as well.

 

You also acknowledge that in the event any claim or demand, or actions including reasonable attorney’s fees, made by any third party or any penalty is imposed due to or arising out of your breach of these terms and conditions or any document incorporated by reference, or your violation of any law, rules, regulations, or the rights of a third party, then You shall indemnify and hold Greenline harmless form any such action.

Greenline expressly makes following disclaimers in relation to the Content etc. on its Greenline Platforms:

 

1.       Any and every Content on any Greenline Platform is provided on “as is” basis and Greenline shall not assume any responsibility, if the same is not found to be true.

 

2.      Further, Greenline expressly disclaims any and every kind of warranty, whether express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

 

3.      Users/visitors using the information provided on the Greenline Platform may do so after satisfying themselves that the same suits their respective requirements.

 

4.     Greenline uses information voluntarily provided by users to optimise their/others’ experience on Greenline Platforms, whether the same is customised to provide personalized experience, or is used to develop content to serve Greenline’s users/customers better.

Limitation of Liability

 

User hereby acknowledges and confirms that Greeline shall not be liable to it or for that matter any person or entity for any loss or damage, whether direct, indirect, incidental, consequential or otherwise, arising out of access or use or dissemination of information contained in any of the Greenline Platforms, including, but not limited to, damages for loss of profits, data, or damage to the user`s computer systems even if Greenline has been advised of the possibility of such damages.

 

Communication

You hereby acknowledge and confirm that either the access or use of any of GreenLine Platforms or sending emails to us directly, shall be treated as acts of electronic communication with us.

When you do that it shall be assumed that You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on any of the Greenline Platforms. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically shall satisfy any legal requirement that such communications be in writing. 

 

Ownership of user generated content

 

The user hereby acknowledges that any review(s), comments, feedback, postcards, suggestions, ideas, and other submissions made, disclosed, submitted or offered in connection with your use of the Greenline Platforms (hereinafter “User Generated Content”) shall instantaneously become the property of Greenline.

 

The user of any of Greenline’s Platform(s) acknowledges and confirms that any User Generated Content including his/her own, shall constitute an assignment to Greenline of all worldwide rights, titles and interests in all copyrights and other intellectual properties User Generated Content, in exchange for the licence to use the given Greenline Platform. Resultantly, Greenline shall exclusively own all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any User Generated Content.

 

We will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any User Generated Content you submit for any purpose whatsoever, without restriction and without compensating you in any way.

 

We shall be under no obligation (a) to maintain any User Generated Content in confidence; (b) to pay you any compensation for any User Generated Content; or (c) to respond to any User Generated Content. You agree that any Comments submitted by you to a Greenline Platform will not violate this policy or any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s), and will not cause injury to any person or entity.

 

You further agree that no User Generated Content submitted by you to the Website will be or contain libelous or otherwise unlawful, threatening, abusive or obscene material, or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of ‘spam’.

 

Greenline does not regularly review any User Generated Content, but does reserve the right (but not the obligation) to monitor and edit or remove any User Generated Content submitted to the Greenline Platform(s).

 

You grant Greenline the right to use the name that you submit in connection with any User Generated Content. You agree not to use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any Comments you submit. You are and shall remain solely responsible for the content of any User Generated Content you make and you agree to indemnify Greenline and its affiliates for all claims resulting from any User Generated Content you submit. Greenline and its affiliates take no responsibility and assume no liability for any User Generated Content submitted by you or any third party.

Greenline’s Privacy Policy (which is provided separately and can be accessed at <<please insert link>> lays out the kind of personal data which is collected when a user and/or visitor signs-up with any of the Greenline Platforms or uses any of our services. It also states the reason as to why such data is collected, and also as to how the same is processed by Greenline to provide you with best-in class services and updates in that respect.

 

Discontinuance, Suspension or Modification

Greenline for any reason may discontinue, suspend or modify any and all of the Greenline Platforms at any time without notice. Further, Greenline may block, terminate or suspend your and any user’s access to the Greenline Platforms at any time in its sole and absolute discretion.

 

Governing law and jurisdiction

The user hereby acknowledges and confirms that the terms and conditions as contained herein, and any disputes, claims etc. arising out of the use of the information from the Greenline Platforms shall be governed by the laws of India and only the Courts at Mumbai shall have exclusive jurisdiction over the same.

 

Termination or Suspension of Accounts

The user further acknowledges and confirms that if he/she breaches or violates any of these terms and conditions then Greenline shall have the right to issue him/her a warning regarding the violation and / or immediately terminate or suspend any or all accounts user might have created using the Greenline Platforms and immediately terminate the contractual agreement between the user and Greenline.
